4. Eligibility

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROADCASTSTUDIO, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE OR SERVICES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless RoadCastStudio, its affiliates, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from:

  1. Your use of and access to the Site or Services, or
  2. Your violation of these Terms or any applicable law.

13. Termination

We may terminate or suspend your access to the Site or Services immediately, without prior notice or liability, if we determine you have breached any of these Terms or if we decide to discontinue the Site or Services. Upon termination, your right to use the Site or Services will cease immediately.

14. Governing Law and Dispute Resolution
